1. Acceptance and scope
These Terms of Use ("Terms") govern your access to ashapoint.com, its job listings, application tools, contact forms, and other online services operated by Asha Point LLC (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
These Terms apply to website visitors, job seekers, applicants, placed workers, employer representatives, and other users. A separate written employment, assignment, client, confidentiality, or other agreement controls if it conflicts with these Terms.
2. Staffing services and employment relationship
AshaPoint recruits, screens, refers, places, and may employ workers for temporary, contract, seasonal, temp-to-hire, or direct-hire opportunities with employer clients. Submitting an application, joining a candidate pool, interviewing, or communicating with AshaPoint does not create an employment relationship, promise an assignment, guarantee any minimum hours, or guarantee placement or continued work.
A job offer or assignment exists only when AshaPoint or an applicable employer client provides a specific offer and the candidate accepts it. Assignment details—including the worksite, schedule, pay, expected duration, supervisor, job duties, safety requirements, and employing entity—will be communicated separately. Client needs may change, and lawful assignments may be modified or ended.
3. Eligibility and accurate information
You must be at least 18 years old, or the legal age required for the position, to submit an application. You agree to provide information that is truthful, current, and complete and to promptly correct material changes. You may not impersonate another person, submit false credentials, omit material facts when lawfully requested, interfere with the Services, introduce malicious code, scrape the Services without permission, or use information obtained here for unlawful or discriminatory purposes.
Employment is subject to verification of identity and authorization to work in the United States. Depending on the role and applicable law, an offer or assignment may also be conditioned on job-related screening, licenses, references, drug or health testing, or a background check. Any third-party consumer report will be handled under the Fair Credit Reporting Act and other applicable laws, including separate disclosure, authorization, and required pre-adverse and adverse-action notices. These Terms are not that authorization.
4. Equal opportunity, accommodations, and fair hiring
AshaPoint is committed to equal employment opportunity and does not make referrals, placements, or other employment decisions based on a characteristic protected by applicable federal, Pennsylvania, or City of Pittsburgh law. This includes, as applicable, race, color, religious creed, national origin, ancestry, sex, pregnancy, sexual orientation, gender identity or expression, age, disability, genetic information, citizenship or immigration status, place of birth, protective or cultural hair textures, styles or head coverings, status as a survivor of domestic violence, use of a guide or support animal, or another legally protected status. AshaPoint also prohibits unlawful harassment and retaliation.
Applicants who need a reasonable accommodation to access the Services or participate in the application or placement process should contact AshaPoint. Job qualifications, screening, and accommodations are evaluated in accordance with applicable law and the essential duties of the particular role.
5. Job and work communications by phone, SMS, email, voice, and WhatsApp
When you give AshaPoint a phone number or email address, you authorize AshaPoint and service providers acting for AshaPoint to contact you about your inquiry, application, job opportunities, interviews, onboarding, assignments, work locations, schedules, shift openings or changes, attendance, timekeeping, payroll, documents, safety, benefits, client updates, and other staffing, employment, or service-related purposes. Communications may be made by telephone call, voicemail, SMS or MMS text, email, WhatsApp, or similar channels, including through automated technology or prerecorded/artificial voice where permitted by law.
Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Consent to automated or marketing communications is not a condition of applying for a job, receiving staffing services, or accepting an assignment. For SMS, reply STOP to opt out and HELP for help. You may also withdraw consent or update your communication preferences by contacting AshaPoint. An opt-out will not prevent non-automated communications that are legally permitted or necessary to administer an active application, employment relationship, assignment, payroll, safety matter, or other transaction you requested. WhatsApp use is also subject to WhatsApp's own terms and privacy practices.
You represent that you control the contact information you provide and will promptly tell AshaPoint if it changes. You agree not to record a call or interview unless all required parties have consented.
6. Job listings and third-party workplaces
AshaPoint aims to keep job postings accurate, but listings may be changed, placed on hold, filled, or removed without notice. Descriptions, pay ranges, schedules, benefits, and assignment durations may be estimates or information supplied by an employer client and do not create a contract. Final terms will be provided during the hiring or assignment process.
Client worksites, systems, policies, and third-party links are controlled by others. While on assignment, workers must follow lawful AshaPoint and client rules, timekeeping procedures, safety instructions, confidentiality obligations, and reporting requirements. Workplace concerns, injuries, harassment, discrimination, requested accommodations, schedule issues, or unsafe conditions should be reported promptly to AshaPoint through the contact information below and, when appropriate, to the onsite supervisor.
7. Website content and intellectual property
The Services and their text, graphics, logos, design, and software are owned by or licensed to AshaPoint and are protected by applicable law. AshaPoint gives you a limited, revocable, nonexclusive right to use the Services for personal job-search, application, staffing, or business-inquiry purposes. No other rights are granted.
You retain ownership of materials you submit. You give AshaPoint a nonexclusive right to host, copy, review, process, and share those materials as reasonably necessary to provide staffing services, consider you for work, comply with law, and operate the Services, subject to the Privacy Policy.
8. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Services are provided "as is" and "as available." AshaPoint does not warrant uninterrupted access, error-free content, a particular job outcome, applicant, placement, assignment length, or business result. Nothing on the website is legal, tax, immigration, medical, or financial advice.
To the fullest extent permitted by law, AshaPoint and its officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services. Nothing in these Terms excludes liability or rights that cannot lawfully be excluded, including applicable employee and applicant rights.
9. Governing law and disputes
Pennsylvania law governs these Terms without regard to conflict-of-law principles. Unless applicable law or a separate signed agreement requires otherwise, disputes relating to these Terms or the Services will be brought in a state or federal court with jurisdiction in Allegheny County, Pennsylvania. Nothing here limits a person's right to contact or file a charge with a government agency or to exercise non-waivable rights.
10. Changes and general terms
AshaPoint may update these Terms by posting a revised version and changing the effective date. Material changes will be communicated when required by law. If one provision is unenforceable, the remaining provisions remain in effect. AshaPoint's failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without AshaPoint's consent.
